Capacity is not an inherent unchanging trait; it exists on a spectrum. In Ontario, adults are presumed to be capable unless there are reasonable grounds to believe otherwise. A person remains capable until a qualified professional makes an assessment and determines they are not.
At nousflow, Johnathon Loftus RSW is a Designated Capacity Assessor under the Substitute Decisions Act, 1992. He is qualified and designated to determine whether an individual is mentally incapable of certain types of decision-making as described in the Act.
